In these terms and conditions, the "Company" will mean Bacco Vino Limited and the "Customer" will mean any person, firm, company or body which places an order with the Company. Please read these terms and conditions carefully before using the site or our mobile App as the case may be (together the “Shop”). By using the site or any part of it, you agree that you have read these terms and conditions and that you accept and agree to be bound by them.
It is illegal to sell alcohol to people under the age of 18 under Hong Kong jurisdiction. By placing an order, the Customer confirms that he/she is 18 years old or above. The Customer shall ensure that no person shall use his/her login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery (within Hong Kong) or delivery shall be withdrawn and attempted at another time agreed.
The Company shall make every reasonable effort to ensure that prices, details and sizes of products at the Shop are up to date. Prices are subject to changes without prior notice and all orders are subject to Company's acceptance at its sole discretion and stock availability.
The Company shall make every reasonable effort to ensure products displayed at the Shop are in stock unless otherwise specified. If from time to time products become out of stock, the Company reserves the right to offer alternative product(s) to the Customer.
Ullages of all wines offered are top shoulder or better, unless otherwise stated. Although the Company strives to find wines in their best condition, the Customer must make appropriate allowances for natural variations of ullages, conditions of cases, labels, foils and corks for old wines (equals to or more than 10 years old).
Payment by the Customer is due immediately upon the issue of order confirmation by the Company. Otherwise, the Company has full discretion to cancel the order.
The Customer is required to register before placing any order through the Shop. During the registration:
The Company has the absolute discretion to refuse registration of any potential customers and to terminate the registration of any customers for any reasons whatsoever.
Customers must inform us immediately of any changes of the information that is required to be provided by him/her so that we can communicate with him/her effectively.
If the Customer buys any of the Company's wines and the Customer does not like a bottle, the Company will credit the Customer's account for that bottle.
If the Customer has bought a whole case of one particular wine, then the Company will refund the whole case PROVIDED THAT only one bottle from the case has been opened.
If, at the time of delivery, any of the bottles in the Customer's case is/are broken, the Customer shall advise the Company immediately, and the Company will refund the purchase price of the broken bottles within seven calendar days.
Outer island returns: In the case of outlying islands, the Customer shall notify the Company and agree a pickup location on Hong Kong island or Kowloon.
Force majeure: The Company shall not be liable for any delay or failure to perform caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failure, or any other causes beyond the control of the Company.
The Customer shall not assign or otherwise transfer any of his/her rights and obligations under these Terms and Conditions to any other third party without the prior written consent of the Company.
If any of these Terms and Conditions shall be construed to be illegal or invalid, they shall be removed from these terms and it shall not affect the legality, validity and enforceability of the other provisions of these Terms and Conditions.
These terms and conditions embody the entire agreement between the parties and they supersede all previous negotiations, representations and agreement between the parties.
The Company will not be liable for any loss or damage caused by the Company or its employees or agents in circumstances where (i) loss or damages was not foreseeable to both parties when the agreement of sale and purchase was made; and/or (ii) loss or damage relates to business and/or non-consumers.
Subject to ‘Refund Policy’ of these Terms and Conditions, the Company shall not be liable for loss or damage caused by the Customer handling the wine, including but not limited to any spillages or breakages.
Under no circumstances shall the Company be liable for special or consequential damages, including loss of business. In no event shall any liability of the Company exceed the purchase price of any product purchased.
All information regarding availability of the Company’s products and/or delivery estimates (whether at the Shop or in the order confirmation or otherwise in relation to products or services) are approximate. The Company will inform the Customer as soon as reasonably practicable if any products and/or services become unavailable.
These terms and conditions shall be governed by the laws of Hong Kong and the Customer and the Company agree to submit to the exclusive jurisdiction of the Hong Kong courts. The Company shall have the right, at any time or from time to time by giving prior notice to the Customer, to modify or vary or supplement any of these provisions under these Terms and Conditions. If any dispute arises, the Company’s determination shall be final. Where these terms and conditions are available in Chinese, the English version is the governing version and shall prevail whenever there is a discrepancy between the two versions.
